CH Adams, LLC d/b/a TidyScooper (“Tidy Scooper”) requires that all customers read, understand, and agree to the terms of service provided below prior to accessing or using this website, creating an account with Tidy Scooper or purchasing any Services. Tidy Scooper’s goal is to provide excellent service. The Terms of Service set expectations and help to facilitate transparency between Tidy Scooper and its customers.
By creating an account with Tidy Scooper, accessing or using the Services, or by accessing and using the Site the customer (you), expressly consent, without limitation or modification, to be bound by these Terms of Use, Tidy Scooper’s Privacy Policy, and all applicable laws.
Services
Tidy Scooper’s services (“Services”) include pet waste removal from a customer’s property. The Services include removal of the pet waste from a designated area and bagging the pet waste to be disposed of in a receptacle at the property provided by the customer. The customer may select Weekly, Biweekly, Monthly subscriptions and a One-time service fee for dog waste removal from customer’s property. Pricing will be dependent upon the number of dogs living at the property. Pricing is available on the website when a quote is requested by the customer.
Tidy Scooper retains the right to decline to provide Services or discontinue a subscription at any time.
SMS Policy
- By submitting any form on this website, you are giving permission for Tidy Scooper to communicate with you via call, text or email at times using automated technology. Tidy Scooper will only communicate when necessary for items such as quote requests, reminders, announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. No purchase is required. If you wish to discontinue the communications from Tidy Scooper reply END or STOP to any email or text message to immediately opt out. Standard text rates apply. Tidy Scooper will not see your information.
E-mail Communications
- From time to time, Tidy Scooper may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our Services, you may receive a notification when you open an email from Tidy Scooper or click on a link therein.
- If you would like to stop receiving marketing or promotional communications via email from Tidy Scooper, you may opt out of such communications by clicking the “Unsubscribe” button in such emails.
Prior to Our Arrival for Your Scheduled Service:
- You must provide to Tidy Scooper the accurate number of dogs that live at the property being serviced on your New Customer Onboarding Form. Failure to truthfully inform Tidy Scooper of how many dogs live at the property will result in immediate cancellation of Services. It is vital that Tidy Scooper staff are fully aware of how many dogs there are on the property. Not having this accurate information could potentially result in safety issues for both staff and your animals.
- You must ensure that the property is not overgrown with grass, trees, or shrubs. The property must also be free from plants and/or other debris that will make scooping difficult. If the property has any standing water, the submerged areas cannot be serviced. Tidy Scooper staff cannot pick up what they cannot see.
- You shall ensure that the property is free of any harmful objects such as holes, nails and other sharp items as well as anything that could be a potential tripping hazard.
- Tidy Scooper will not clean properties that contain loose animals or tethered/chained animals.
- For the safety of your animals and the Tidy Scooper staff, it is the customer’s responsibility to ensure all animals are indoors while Tidy Scooper provides its services to the property. The customer is encouraged to secure all animals during service times to prevent service disruptions.
- If an animal is present and restricts access to service areas, the staff member may attempt to contact the customer for assistance. If the staff member cannot safely perform the service within 10 minutes of arrival, the visit will be considered completed, and the full service fee will apply.
- Tidy Scooper is not responsible for injuries to any animals.
- If an animal is released into the service area while service is being performed. The technician will halt service and leave the service area until the animal is placed back inside. If the technician is not able to reenter the service area, the visit will be considered completed, and the full-service fee will apply.
- You must ensure that all gates are unlocked at the time of service. Any gate code or key would need to be provided by the customer to Tidy Scooper. Properties or service areas with locked gates or that are not accessible will not be serviced.
- You must provide an available trash receptacle for your animals’ waste. Tidy Scooper will secure the waste and place it in your trash receptacle.
- Should Tidy Scooper be unable to gain access to the property or service area, you will be charged for Services even though Tidy Scooper is unable to perform such Services.
Changes to Family Pets
- Welcoming a new pet into the family or has one of your pets crossed the rainbow bridge? You must inform Tidy Scooper via email or text message of the exact number of animals that live at the property. It is important to update Tidy Scooper for both operational, safety, and billing purposes.
- In the event of the addition of a new pet, failure to notify Tidy Scooper may result in the cancellation of service. Tidy Scooper must be aware of all animals on site so its staff can remain fully aware of their surroundings for safety purposes. This is for the safety of Tidy Scooper’s staff and your animals.
Payments
- Customers must agree to and sign up for auto billing. Tidy Scooper requires customers to keep a valid form of payment on file for the recurring Monthly billing cycle. Service fee(s) will be charged at the beginning of each Month. Customers will securely provide this information upon creating their Customer Portal profile. Customers can update their own information and review billing and scheduling details via customer dashboard. Tidy Scooper will never have access to your credit card information for any use outside of customer billing for Tidy Scooper services.
- We do not accept cash or money orders for payment.
- Customers are able to award employees tips through existing payment methods.
Declined Payments/Past Due Accounts
- There will be a $15 fee for declined credit card transactions, as well as a $25 per month late fee added to each past due invoice.
- Services will be suspended for any non-payment on an invoice. Service will resume once payment in full is received. Customers may be subject to a property reset fee based on the time in between cleanings.
- Accounts will be closed and service agreements cancelled for customers that are 15 days past due.
Office Hours/Scheduling
- Office Hours are Monday – Friday between the hours of 8:00 am – 5:00 pm. Service hours are during day light hours; this is subject to change due to daylight savings time.
- Tidy Scooper does not offer service on the following days:
- New Years Day
- Martin Luther King Day
- Memorial Day
- Independence Day
- Labor Day
- Veterans Day
- Thanksgiving Day (2 days observed)
- Christmas Day (2 days observed)
- Customers will have a regularly scheduled day(s) for service – weather permitting.
- For route optimization purposes, service day(s) are subject to change.
- Customers will receive a text message when Tidy Scooper staff are in route to the property.
- Customers will receive a text or email notification once the Service has been completed.
Temporary Changes to Service
- Tidy Scooper is a small business with a small number of staff. It will use its best efforts to adjust the schedules (to ensure the continuation of service) in observance of the holidays, staff vacations and call outs, and inclement weather.
- Tidy Scooper will provide as much advance notice as possible and kindly request your patience and flexibility for temporary changes to the schedule.
Appointment Cancellations
If Tidy Scooper cancels a Scheduled Service:
- Customers will be contacted 24 hours in advance should the service need to be rescheduled with the exception of unexpected inclement weather or unforeseen emergency. A notice of cancellation will be provided to the customer in writing via text message sent to the cell phone number on file. Tidy Scooper will not charge for these situations.
If the Customer Cancels a Schedule Service:
- Should a customer need to cancel and/or reschedule, please contact Tidy Scooper 24 hours in advance via phone, call or text:

- If notice is not received 24 hours in advance or if Tidy Scooper arrives at the property but can’t provide your Service, you will be charged for the Service.
- Customers that skip or cancel 2 or more services without removing their pet’s waste during that time may be subject to an additional fee due to the amount of waste that has accumulated in between Services.
Cancellation of Service
Either Tidy Scooper or the customer may cancel at any time.
- Cancellations must be submitted in writing via email: service@tidyscooper.com
- For customers with a subscription, a cancellation notice must be provided 30 days prior to the desired end date for the subscription.
- All completed or in-process services must be paid for in full.
- If a customer cancels subscription within a promo window, the customer will be charged a one-time clean up fee, or the original price of the service.
- Should Tidy Scooper choose to cancel Service, written communication will be sent to the customer via the email on file.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TIDY SCOOPER, AND MANAGERS, MEMBERS, EMPLOYEES, AGENTS, LICENSORS, LICENSEES, CONTRACTORS AND AFFILIATES SHALL NOT BE LIABLE FOR ANY COMPENSATORY, SPECIAL, INCIDENTAL, CONSEQUENTIAL, INDIRECT, EXEMPLARY OR PUNITIVE DAMAGES, LOST PROFITS, COSTS TO PROCURE SUBSTITUTE SERVICES OR GOODS, PROPERTY DAMAGE, , DISCLOSURE OF CONFIDENTIAL OR OTHER PROPRIETARY INFORMATION, LOSS OF PRIVACY, FAILURE TO MEET ANY DUTY OWED, INCLUDING GOOD FAITH AND REASONABLE CARE, NEGLIGENCE OR OTHERWISE, REGARDLESS OF THE FORESEEABILITY OR NOTICE OF SUCH DAMAGE GIVEN TO TIDY SCOOPER OR ITS MANAGERS, MEMBERS, EMPLOYEES, AGENTS, LICENSORS, LICENSEES, CONTRACTORS, OR AFFILIATES THAT ARISE OUT OF OR ARE CONNECTED IN ANY WAY WITH YOUR ACCESS TO OR USE OF THE SITES OR SERVICES. THIS LIMITATION SHALL APPLY TO ALL DAMAGES, INCLUDING, BUT NOT LIMITED TO, THOSE ARISING FROM BREACH OF CONTRACT, NEGLIGENCE, TORT, OR ANY OTHER LEGAL THEORY OR CAUSE OF ACTION.
THE MAXIMUM LIABILITY OF TIDY SCOOPER AND ITS MANAGERS, MEMBERS, EMPLOYEES, AGENTS, LICENSORS, LICENSEES, CONTRACTORS AND AFFILIATES SHALL BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU IN THE NINETY (90) DAYS IMMEDIATELY PROCEEDING ANY CLAIM TO TIDY SCOOPER FOR THE SERVICES. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT THIS LIMITATION OF LIABILITY IS A REASONABLE ALLOCATION OF RISK, THAT IT IS A FUNDAMENTAL TERM OF THE BASIS OF THE BARGAIN BETWEEN TIDY SCOOPER AND YOU, AND THAT THE SITES AND SERVICES WOULD NOT BE PROVIDED TO YOU IN THE ABSENCE OF THIS LIMITATION OF LIABILITY. THIS LIMITATION OF LIABILITY SHALL SURVIVE THE TERMINATION OR AMENDMENT OF THESE TERMS.
TIDY SCOOPER SHALL NOT BE RESPONSIBLE OR LIABLE FOR FAILURE TO PERFORM ANY OF ITS OBLIGATIONS SET FORTH IN THE TERMS IF SUCH FAILURE IS CAUSED BY OR THE RESULT OF ANY OCCURRENCE OF AN UNFORESEEN CIRCUMSTANCE THAT IS BEYOND ITS REASONABLE CONTROL, INCLUDING, BUT NOT LIMITED TO, INTERNET SERVICE DISRUPTION, FIRE, FLOOD, NATURAL DISASTER, CIVIL UNREST, WAR OR ANY ACT OF GOD, TERRORISM OR NATURE.
Miscellaneous
- These Terms of Service constitute the complete, final and exclusive agreement between Tidy Scooper and you regarding your access to and use of the site and Services and supersedes all other communications, agreements, communications and courses of dealing between Tidy Scooper and you.
- From time to time Tidy Scooper may, in its sole discretion, amend, supplement or otherwise modify the Terms of Service or the Privacy Policy. The Terms of Service or the Privacy Policy may not otherwise be amended, supplemented or otherwise modified unless in a signed writing by the manager of Tidy Scooper.
- Notwithstanding contrary provisions contained herein, Tidy Scooper reserves the right to terminate your access to and use of the site and Services at any time without notice to you and in the Company’s sole discretion for any reason or no reason. You expressly agree that the Company shall not be liable for any termination or interruption of access to or use of the site or Services.
- If any provision, clause or portion of these Terms of Service shall be determined to be unlawful, void, or unenforceable for any reason, then that provision, clause or portion shall be deemed struck from the Terms and shall not affect the validity of the remainder of the Terms of Service.
- You agree that these Terms of Service, the Privacy Policy and any dispute between Tidy Scooper and you will be governed exclusively by the laws of the State of Louisiana and the laws of the United States, without regard to the principles of conflict of laws. Louisiana law and the laws of the United States will apply to any claim or dispute arising under the Terms of Service, regardless of your domicile, residence, or the location where you access or use the Sites or Services.
- You expressly agree that the exclusive jurisdiction and venue of any claim, dispute or cause of action that arises in relation to or connection with these Terms of Service or the Privacy Policy shall be the federal and state courts located in Caddo Parish, Louisiana. You expressly submit to the personal and subject-matter jurisdiction of those courts and waive any claim or defense of an inconvenient forum.
- All notices required or permitted to be given pursuant to the Terms of Service shall be in writing. Notice shall be given to Tidy Scooper by email to: service@tidyscooper.com.
- You explicitly agree that Tidy Scooper may provide notice to you by sending an email to the address on file and that such e-mail satisfies any requirement that such notice be in writing and that notice to you shall be deemed effective upon Tidy Scooper sending an email to that address. You are solely responsible for ensuring that your email address on file with Tidy Scooper is current and accurate.
- Tidy Scooper may assign these Terms of Service or its rights or obligations pursuant to these Terms of Service to any person or entity at any time, for any reason, with or without notice to you. You shall not assign these Terms of Service, or your rights or obligations pursuant to these Terms of Service at any time.
